Welcome to Dutch Brothers Racing.

This store and website are operated by A S R Strategies (Advanced Safety and Risk), trading as Dutch Brothers Racing. Throughout these Terms of Service, the terms "we", "us" and "our" refer to A S R Strategies.

A S R Strategies provides this store and website, including all related information, content, features, tools, products and services, to provide customers with a curated shopping experience. These are collectively referred to as the "Services".

Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced within them, describe your rights and responsibilities when you access or use the Services.

Please read these Terms of Service carefully. They contain important information about your legal rights, including provisions relating to warranties and limitations of liability.

SECTION 1 - ACCESS AND ACCOUNTS

By agreeing to these Terms of Service, you confirm that you are at least 18 years old or have reached the legal age of majority in your country of residence.

If you permit a minor under your care to use the Services, you are responsible for supervising their use of the Services.

To access or use certain parts of the Services, including purchasing products, you may be asked to provide information such as your name, email address, billing information, payment information and shipping address.

You confirm that all information you provide is accurate, current and complete and that you have the right to provide that information.

You are responsible for maintaining the security of your account credentials and for activity conducted through your account. You may not transfer, sell, assign or license your account to another person.

SECTION 2 - OUR PRODUCTS

We make reasonable efforts to display and describe our products accurately. However, colours, proportions and other aspects of a product's appearance may vary depending on your screen, device settings and configuration.

Product photographs, illustrations and mock-ups are intended to represent the product as accurately as reasonably possible. Minor variations may occur in final production, particularly in colour, positioning, embroidery, printing and finishing.

We do not guarantee that a product will appear exactly as it does on your screen. This does not affect your rights where a product is defective, materially different from its description or otherwise fails to meet rights provided by applicable law.

Product descriptions, specifications and availability may be changed without notice. We may discontinue products or limit the quantity available to any person, geographic region or jurisdiction.

SECTION 3 - ORDERS

When you place an order, you are making an offer to purchase the selected products.

We reserve the right to accept or decline an order where permitted by applicable law. An order is not accepted until we issue an order confirmation or otherwise confirm acceptance.

We must receive and process payment before an order is accepted.

Please review your order carefully before submitting it. We may be unable to accommodate a cancellation request after an order has been accepted or entered production.

If we decline, change or cancel an order, we will attempt to contact you using the email address, billing address or telephone number supplied with the order.

You confirm that purchases are for personal or household use and are not intended for unauthorised commercial resale or export.

SECTION 4 - PRE-ORDERS

Products identified as pre-order items are not available for immediate dispatch.

Payment for a pre-order is taken when the order is placed unless otherwise stated during checkout.

Any production, dispatch or delivery date shown for a pre-order is an estimate and is not guaranteed. Production schedules may change due to manufacturing, shipping, customs or other circumstances outside our reasonable control.

If a significant delay occurs, we will make reasonable efforts to inform affected customers using the contact information supplied with their orders.

An order containing both available products and pre-order products may be dispatched together or separately, depending on product availability and the shipping method used.

Requests to cancel or amend a pre-order are handled in accordance with our Refund Policy and any mandatory rights provided by applicable law.

SECTION 5 - PRICES AND BILLING

Prices, discounts and promotions may change without notice. The price charged will be the price displayed when the order is placed and will appear in the order confirmation.

Displayed prices are in UAE Dirhams and include UAE VAT at 5% where applicable.

Shipping, handling, customs duties, import taxes and other destination charges may be charged separately where applicable. International customers are responsible for customs duties, import taxes and other charges imposed by their destination country unless expressly stated otherwise.

Prices on our website may differ from prices offered through physical locations, events or third-party retailers.

Promotions may be subject to additional conditions. If promotional conditions conflict with these Terms of Service, the promotional conditions will apply to that promotion.

You agree to provide accurate and complete payment and account information and to update that information when necessary.

You confirm that you are authorised to use the payment method supplied and agree to pay all properly disclosed charges associated with your order.

SECTION 6 - SHIPPING AND DELIVERY

Shipping methods, charges and estimated delivery times are displayed during checkout where available.

Delivery dates and transit times are estimates only unless we expressly agree otherwise.

We are not responsible for delays caused by carriers, customs processing, inaccurate delivery information, events outside our reasonable control or a recipient's failure to accept delivery.

We remain responsible for the products until they are delivered to the address supplied with the order, except where applicable law provides otherwise.

Customers are responsible for ensuring that the delivery address and contact information provided are accurate and complete.

SECTION 7 - INTELLECTUAL PROPERTY

The Services, including our trademarks, brands, text, images, graphics, videos, audio, product designs and the selection and arrangement of website content, are owned by or licensed to A S R Strategies.

These materials are protected by applicable copyright, trademark and other intellectual-property laws in the United Arab Emirates and internationally.

The Services are provided for personal, non-commercial use. Unless expressly permitted, you may not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store or transmit material from the Services without our prior written consent.

Nothing in these Terms of Service grants you a licence or other right to use any intellectual property belonging to A S R Strategies, Dutch Brothers Racing, Shopify or any third party.

Unauthorised use of the Services may violate applicable intellectual-property laws.

The names, logos, product names, service names, designs and slogans associated with A S R Strategies and Dutch Brothers Racing may not be used without prior written permission.

Shopify's name, logos, product names, service names, designs and slogans are trademarks of Shopify. Other names and marks displayed through the Services belong to their respective owners.

SECTION 8 - OPTIONAL TOOLS

We may provide access to tools or functionality supplied by third parties.

We do not control or monitor every third-party tool. Access may be provided on an "as is" and "as available" basis to the extent permitted by applicable law.

Your use of optional third-party tools is at your discretion and may be subject to separate terms and privacy policies issued by the relevant provider.

New tools, features and resources introduced through the Services will also be subject to these Terms of Service unless stated otherwise.

SECTION 9 - THIRD-PARTY LINKS

The Services may contain links to websites, services or materials operated by third parties.

We are not responsible for examining or guaranteeing the accuracy, security or content of third-party websites or services.

If you leave our Services to access a third-party website, you do so subject to that third party's terms and policies.

To the extent permitted by applicable law, we are not responsible for harm or loss arising from your independent use of third-party websites, products or services.

Questions or complaints relating to a third-party product or service should be directed to the relevant third party.

SECTION 10 - RELATIONSHIP WITH SHOPIFY

Dutch Brothers Racing is powered by Shopify, which enables us to provide the Services.

However, purchases made through our store are made directly from A S R Strategies.

Shopify is not the seller of our products and is not responsible for the fulfilment of orders, product quality, customer service or other aspects of a sale between you and A S R Strategies.

To the extent permitted by applicable law, you release Shopify and its affiliates from claims arising directly from products purchased from A S R Strategies.

SECTION 11 - PRIVACY

Because the Services are hosted by Shopify, Shopify processes information concerning your access to and use of the Services to provide and improve its services.

Information submitted through the Services may be processed by Shopify and other service providers in countries outside your country of residence, subject to applicable data-protection requirements.

If you submit ideas, suggestions, feedback, reviews, proposals or other content relating to the Services, you grant us a worldwide, non-exclusive, royalty-free and sublicensable licence to use, reproduce, adapt, publish, distribute and display that content for purposes connected with operating, improving and promoting the Services.

Information available through the Services may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times or availability.

We may correct errors, update information or cancel affected orders where information is materially inaccurate, subject to applicable law.

If we cancel an order after payment due to an error or unavailability, we will refund the amount paid for the cancelled item or order.

You may access and use the Services only for lawful purposes.

You may not use the Services:

(a) for an unlawful, fraudulent or malicious purpose;

An "Agent" means software or a service that takes autonomous or semi-autonomous action on behalf of a person or organisation.

Agents must identify themselves accurately and must not conceal their automated nature, impersonate human behaviour to bypass security measures, circumvent access restrictions or attempt to defeat CAPTCHAs or similar safeguards.

We may restrict or prevent automated access to the Services where necessary to protect the Services, customers or other users.

We may suspend or terminate access to the Services where permitted by law, including where these Terms of Service have been violated.

Termination does not affect rights, obligations or amounts that arose before termination.

Provisions concerning intellectual property, feedback, disclaimers, liability, indemnification, governing law and other provisions that by their nature should survive will continue after termination.

Information presented through the Services is provided for general information purposes.

Although we make reasonable efforts to maintain accurate information, we do not guarantee that all content will be complete, current or free from error.

To the fullest extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis.

We do not guarantee that access to the Services will always be uninterrupted, timely, secure or error-free.

To the fullest extent permitted by applicable law, A S R Strategies and its directors, officers, employees, affiliates, agents, contractors, service providers and licensors will not be liable for indirect, incidental, special or consequential loss arising from use of the Services or products purchased through the Services.

This may include loss of profit, revenue, savings, data or opportunity where such loss was not a reasonably foreseeable result of our breach.

Any limitation of liability in these Terms of Service is subject to mandatory consumer rights and other protections provided by applicable law.

SECTION 19 - INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify A S R Strategies, Shopify and their respective affiliates, officers, directors, employees, agents, contractors, licensors and service providers against third-party claims, losses, damages and reasonable legal costs arising from:

(a) your material breach of these Terms of Service;
(b) your violation of applicable law or another person's rights; or
(c) your unlawful misuse of the Services.

We will provide reasonable notice of an indemnifiable claim and may control its defence and settlement.

We will not agree to a settlement that imposes a non-financial obligation on you without your consent, which must not be unreasonably withheld.

SECTION 20 - SEVERABILITY

If any provision of these Terms of Service is found to be unlawful, invalid or unenforceable, that provision will be enforced to the fullest extent permitted by law or severed to the minimum extent necessary.

The remaining provisions will continue in effect.

SECTION 21 - WAIVER AND ENTIRE AGREEMENT

A failure or delay in exercising a right under these Terms of Service does not waive that right.

These Terms of Service and the policies referenced within them constitute the entire agreement between you and us concerning your use of the Services.

They replace previous agreements or communications relating to the same subject matter.

You may not transfer or assign your rights or obligations under these Terms of Service without our prior written consent.

We may transfer or assign our rights and obligations as part of a legitimate business transfer, restructuring or similar transaction, subject to applicable law.

These Terms of Service and any separate agreement through which we provide the Services are governed by the applicable laws of the United Arab Emirates.

Subject to any mandatory consumer rights or jurisdictional requirements, the courts of Dubai, United Arab Emirates will have jurisdiction over disputes arising from or connected with the Services or these Terms of Service.

SECTION 24 - CHANGES TO THESE TERMS

The current version of these Terms of Service will be available on this page.

We may update these Terms of Service by publishing a revised version through the Services.

Where required by law, we will notify customers of material changes. Changes will take effect on the date stated in the updated Terms of Service or associated notice.

Continued use of the Services after changes take effect constitutes acceptance of the revised Terms where permitted by applicable law.
